1. Agreement to Terms
By accessing or using Janix Event Suite ("Services"), including purchasing tickets, registering for events, or creating an account, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
2. Description of Services
Janix Event Suite is a multi-tenant ticketing and event management platform that enables arts organizations, festivals, and event producers to sell tickets, manage check-ins, and engage with their audiences. Our Services include:
- Online ticket purchasing and digital ticket delivery
- Event registration and check-in
- Audience relationship management for event organizers
- Payment processing via Stripe
3. Eligibility
Age Requirement: You must be at least 13 years of age to use our Services. If you are under 18, you must have permission from a parent or guardian. By using our Services, you represent that you meet these requirements.
4. User Accounts
Account Creation
To purchase tickets or register for events, you may need to create an account. We use passwordless authentication via email magic links for your security and convenience.
Account Responsibility
You are responsible for:
- Providing accurate and current information (name, email address)
- Maintaining access to your registered email address
- All activities that occur under your account
- Notifying us if you believe your account has been compromised
5. Ticket Purchases and Payments
Payment Processing
All payments are processed securely through Stripe. By making a purchase, you also agree to Stripe's Terms of Service. A 12% platform fee is included in the ticket price to support the operation of the platform.
No Refunds: All ticket sales are final. Tickets are non-refundable and non-transferable unless the event is cancelled by the organizer. If an event is cancelled, the event organizer will contact ticket holders regarding refund procedures.
Ticket Delivery
Upon successful purchase, you will receive a confirmation email with your digital ticket(s) containing a QR code for event check-in. It is your responsibility to ensure you can access your tickets for the event.
6. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Resell or transfer tickets without authorization from the event organizer
- Provide false or misleading information
- Interfere with or disrupt the Services or servers
- Use automated systems (bots) to purchase tickets
- Harass, abuse, or harm other users or event staff
7. Event Organizer Relationship
Janix provides the technology platform; individual events are organized and managed by third-party event organizers. Each event organizer is responsible for:
- Event content, scheduling, and execution
- Event-specific policies (e.g., age restrictions, accessibility)
- Communicating event changes or cancellations
- Processing refunds for cancelled events
8. Intellectual Property
The Janix platform, including its design, features, and content, is owned by Janix and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of our Services without permission.
9. Disclaimer of Warranties
Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:
- The Services will be uninterrupted or error-free
- Events will occur as scheduled (this is the organizer's responsibility)
- All information provided by event organizers is accurate
10. Limitation of Liability
To the maximum extent permitted by law, Janix shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
- Your use or inability to use the Services
- Event cancellations, changes, or quality
- Actions or omissions of event organizers
- Unauthorized access to your account
Our total liability for any claim shall not exceed the amount you paid for the specific ticket(s) at issue.
11. Account Suspension
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse our Services. We may also suspend accounts that have been inactive for an extended period.
12. Privacy
Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
13. Changes to Terms
We may update these Terms from time to time. The version date at the top indicates when the Terms were last revised. Continued use of our Services after changes constitutes acceptance of the updated Terms. We may require you to re-accept Terms for significant changes.
14. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Austin, Texas.
