Janix Attendee Terms

These Attendee Terms (“Attendee Terms”) apply when you register for, or buy a ticket or pass to, an event hosted by an event organizer (“Organizer”) through the Janix platform operated by Janix, Inc. (“Janix,” “we,” “us,” or “our”). They add to, and should be read with, the Janix Terms of Service and the Janix Privacy Policy, which also apply to your use of the platform.
You are buying from the Organizer, not from Janix. When you buy a ticket or pass, your purchase is a contract between you and the Organizer. The Organizer is the seller and the merchant of record. Janix provides the technology that powers the Organizer’s event and facilitates your payment through Stripe, but Janix is not the seller, the event host, or the merchant of record, and is not a party to your purchase.
ARBITRATION NOTICE. Section 10 contains a binding arbitration provision and a class action waiver that govern disputes between you and Janix. Disputes about an event, ticket, or refund are with the Organizer.
1. You, the Organizer, and Janix
- The Organizer is the seller and merchant of record for your ticket or pass and is responsible for the event—its content, scheduling, delivery, any change, postponement, or cancellation, and all refunds.
- Janix is a technology platform and payment facilitator. Janix is not a party to the sale, does not host or produce the event, and is not responsible for the Organizer’s acts or omissions.
- You are the person registering for or purchasing the ticket or pass.
2. Buying a Ticket or Pass
When you complete a purchase, you agree to the price shown, the Organizer’s event terms, and the Organizer’s Refund Policy presented at checkout. Payments are processed by Stripe, Inc. (“Stripe”) into the Organizer’s connected Stripe account. Janix does not hold your funds or store your full card details. You authorize the charge to your payment method for the amount shown, including any taxes or fees the Organizer applies.
3. Refunds and Cancellations — the Organizer’s Policy Governs
Each Organizer sets its own Refund Policy, which is shown to you at checkout and forms part of your contract with the Organizer. Because the Organizer is the merchant of record, all refunds, credits, exchanges, and cancellations are handled by the Organizer under that policy, and any refund is issued from the Organizer’s account. Janix does not set, control, or issue refunds and is not responsible for an Organizer’s refund decisions. For any refund request or question, contact the Organizer. If an event is changed, postponed, or canceled, the Organizer’s Refund Policy and applicable law govern what you are entitled to.
Your legal rights. Where the law gives you non-waivable refund or cancellation rights—such as certain EU or UK consumer rights, or consumer-protection rights in your home state—those rights continue to apply regardless of an Organizer’s policy.
4. Tickets and Entry
A ticket or pass is a limited license from the Organizer to attend the event, subject to the Organizer’s rules and any conditions associated with the ticket. The Organizer controls admission, capacity, conduct rules, age and health-and-safety requirements, and entry. You may resell or transfer a ticket only as the Organizer permits. Do not duplicate, alter, or use tickets fraudulently.
5. Your Information and Privacy
To buy a ticket you provide certain information, such as your name and email. For information you provide in connection with an Organizer’s event, the Organizer is the controller and Janix acts as the Organizer’s processor; the Organizer’s own privacy notice governs how the Organizer uses that information. For your Janix account itself—your magic-link login and profile—Janix is the controller, as described in the Janix Privacy Policy. An Organizer may contact you about its event and, where it has the necessary relationship or your consent, may send you marketing email; the Organizer is the sender of those communications, and you can opt out with the Organizer.
6. Eligibility
You must be at least 13 years old to buy a ticket or pass. If you are under 18, your parent or legal guardian must agree to these Attendee Terms on your behalf, and by purchasing you represent that they have done so. Individual events may have additional age requirements set by the Organizer.
7. Acceptable Use
You agree to provide accurate information, to use the platform only for lawful purposes, not to use any ticket fraudulently, and to follow the Organizer’s rules for its event. We may cancel a transaction or restrict access if we reasonably believe it involves fraud or a violation of these Attendee Terms or the Janix Terms of Service.
8. Disclaimers
THE JANIX PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. JANIX IS NOT RESPONSIBLE FOR ANY EVENT, FOR ANY ORGANIZER, OR FOR ANY TRANSACTION BETWEEN YOU AND AN ORGANIZER, AND DOES NOT GUARANTEE THAT ANY EVENT WILL TAKE PLACE, OCCUR AS DESCRIBED, OR ACHIEVE ANY RESULT. THE ORGANIZER, NOT JANIX, IS RESPONSIBLE FOR THE EVENT AND FOR REFUNDS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JANIX AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO THE PLATFORM, AN EVENT, OR YOUR PURCHASE. JANIX’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE PLATFORM OR YOUR PURCHASE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS, IF ANY, YOU PAID DIRECTLY TO JANIX, OR (B) ONE HUNDRED U.S. DOLLARS ($100). NOTHING IN THESE ATTENDEE TERMS LIMITS THE ORGANIZER’S LIABILITY TO YOU OR ANY LIABILITY THAT CANNOT BE LIMITED BY LAW.
10. Disputes With Janix; Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY—IT AFFECTS YOUR LEGAL RIGHTS.
This Section governs disputes between you and Janix. Disputes about an event, a ticket, or a refund are with the Organizer and are not governed by this Section as between you and the Organizer; the Organizer may have its own terms.
Informal resolution first. Before bringing a formal claim against Janix, contact support@janix.ai and allow 30 days to resolve the dispute informally.
Binding arbitration. Except as set out below, any dispute between you and Janix arising out of or relating to the platform or these Attendee Terms will be resolved by binding, individual arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in court. The Federal Arbitration Act governs this Section. The seat and location of any arbitration will be Travis County, Texas, unless applicable law requires otherwise. You may still bring an individual claim in small-claims court located in Travis County, Texas, if it qualifies.
Class action waiver. YOU AND JANIX AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.
30-day opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Attendee Terms by emailing support@janix.ai with your name and a clear statement that you wish to opt out of arbitration.
11. Governing Law
These Attendee Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Subject to Section 10, the state and federal courts located in Travis County, Texas, have jurisdiction over disputes with Janix not subject to arbitration. Nothing in this Section deprives you of the protection of the mandatory consumer-protection laws of the jurisdiction where you live—for example, the Texas Deceptive Trade Practices–Consumer Protection Act, where it applies.
12. Changes to These Terms
We may update these Attendee Terms. When we make material changes, we will require you to accept the updated terms before your next purchase or continued use of the platform.
